Terms and Conditions of Holiday Letting for the property “Fishcakes”, Kinka Road, Seal Rocks.

Effective March 2011

  1. The premises are let for holiday purposes only for the period stated on your letter of confirmation and receipt. All monies are accepted on behalf of the property owner Stephen Grant who reserves the right to cancel any booking should anything arise (ie storm damage, urgent repairs, theft, etc) which may render the booking impractical. In such an event we shall notify you as soon as possible and refund any monies which you have forthwith paid. All telephone, internet and postal bookings are taken in good faith, with any written or verbal description of the premises made in good faith also. No responsibility for discrepancies will be accepted. Please ensure that you have viewed the information on our website carefully before making your booking. No provision for compensation will be made if you are unhappy with the property on arrival.
  2. “Fishcakes” is available from 2pm on the day of arrival and must be vacated at 10am on the day of departure. This strictly applies during school holiday and peak periods. Differing check in and out times maybe possible only during non peak periods and will only be confirmed 48hrs prior.
  3. Pending bookings will be held for 5 days only, during which time a 50% deposit, for weekly bookings must be paid to secure the booking. Balance of monies must then be paid 14 days prior to the arrival date. Weekend and broken week bookings must be paid in full to secure the booking. A signed and completed Booking Authorisation Form (the above downloadable PDF on this page) must be completed and returned at the time of booking. This requires that you read, accept and acknowledge these Terms and Conditions and outlines your committment to pay the required Security Bond (see section 5.)  
  4. Cancellations must be notified in writing and will only be refunded if a new booking can be secured for the same time period of your original booking. If a new booking cannot be secured your monies will not be refunded. If a new booking can be secured a $150.00 cancellation fee will then only apply.
  5. A security deposit of $500.00 must also be paid 7 days prior to arrival. This will be refunded to you within 7 days after departure should there be no issues. Issues that could arise which may jeopardise your security deposit release may include:
    • Excess cleaning, all dishes must be washed and put away and dirty linen left neatly in piles. Excess rubbish removal, excess laundering, and BBQ cleaning.
    • Breakages and damages to the property (see section 12), a penalty for breaching tenancy such as overcrowding or function use (see section 6&7), theft, loss or damage should the property be left unsecured at your departure, keys not returned (see section 11), if a pet has stayed at the property (see section10), or the postage return of personal items left at the premises (see section 15).
  6. The maximum number of people to occupy “Fishcakes” at any one time should not exceed 8: 6 adults with 2 children or 4 adults and 4 children, with no more than 6 adults at any one time.  If overcrowding should occur you will be in breach of contract and your tenancy will be immediately terminated. This also applies to visitors during your stay, additional 'overnight' guests will not be tolerated. Your tenancy will be terminated and you will be promptly evicted from the property by Fishcakes management.
  7. “Fishcakes” is let solely for residential holidaying purposes only. Large group celebrations, parties and weddings, functions of any kind will not be tolerated. Excessive noise will not be tolerated. Should you breach this clause your tenancy will be terminated immediately and you will be promptly evicted from the property by Fishcakes management.
  8. “Fishcakes” is connected to tank water only. Waste water is treated with an onsite disposal system. When staying at “Fishcakes” we ask that you are mindful at all times of your water usage and that no harsh chemical detergents or anti bacterial products be used and washed into the enviro cycle waste management system. We ask that should you need to use the laundry facilities during your stay that you do so in a manner which minimises water consumption. We also ask that you be mindful of the duration of time spent showering, particularly during dry summer periods.
  9. Linen will NOT be provided at “Fishcakes”. You will need to bring your own towels and sheets. Fresh laundered mattress protectors, pillows with pillowslips and covered doonas will be supplied. Sheets and beds can be made for you on arrival at your request for an additional fee. All dishwashing powders and liquids, tea towels, cleaning products, laundry powder, and minimal toilet paper only will be provided. Personal toiletries will not be available.
  10. Pets are not allowed at “Fishcakes”
  11. Keys. An arrangement for key collect or property access will be arranged 7 days prior to your arrival at the time of paying your security deposit. Access to Fishcakes will only be given once all balance of monies have been paid, including the security bond and the signed Bond Form has been received. Keys will be your responsibility during your stay. If keys are misplaced during your stay you will be charged $75.00 for a replacement set.
  12. All breakages or damage must be reported immediately. All furniture and equipment must be left as it was found at the time of your arrival.
  13. “Fishcakes” has shared driveway access with the neighboring property. Please ensure that you are mindful of other vehicles when entering or exiting the driveway at all times. Any damage to your vehicle or neighboring vehicle is the responsibility of the driver at fault.
  14. “Fishcakes” has large full opening sliding front windows. We advise that if you have small children staying at the property, or if you use the front daybed, that you keep these closed at all times. Should you decide to open these windows you do so at your own risk. The owner will not be held responsible for any accident or injury which may occur due to the opening of these windows should you decide to do so.
  15. No responsibility is taken for guests personal belongs being left at the premises. Should it be found after vacating a suitable postage and handling fee will be charged for its return at your request.
  16. The owner of “Fishcakes” cannot be responsible for any neighboring building work or other noise issues from neighboring properties. We are also not responsible for the weather during your stay. If you decide to vacate early due to any of these issues a refund will not be available.
  17. You are required to allow access to repair or service personnel to enter the premises for the purpose of conducting any repair or service deemed necessary by the owner. Unless an emergency situation does arise, access will generally be required between the hours of 9am and 5pm.

Other important information

Rubbish bins are collected from the bottom of the drive early Wednesday mornings and must be put out for collection on Tuesday evening. The red waste bin weekly and the yellow recycle bin fortnightly. Bins are also collected Saturday mornings during the Christmas January school holiday period.

Should you engage the secondary gas bottle during your stay it is imperative that you leave a note for housekeeping that you have done so. If you fail to do this you will greatly inconvenience someone else after you.

The hot water system is solar hot water. During winter, or overcast rainy days a booster switch is located near the concrete wash tubs to engage the electricity to the hot water system. We ask that this only be used if necessary.
